According to statistics, from September 2021 to August 2023, the national procuratorial organs filed more than 40,000 public interest litigation cases in the field of safety production and prosecuted more than 100 cases. The typical cases released this time include 12 administrative public interest litigation cases in which the People’s Procuratorate of Jintang County, Sichuan Province urged to rectify the hidden dangers of illegal filling of bottled liquefied petroleum gas, involving gas, construction projects, transportation, fire protection, mines, hazardous chemicals, industry and trade, etc. The supervision of the industry covers a wide range and there are many types of violations, which shows the practice and effectiveness of procuratorial organs in handling various types of public interest litigation cases in the field of safety production.
The case highlights the concept of preventive justice, emphasizes the prevention and resolution of major risks and hidden dangers, pays more attention to the causes of hidden dangers, accurately investigates hidden dangers, and strives to expand the depth of supervision. For example, the Procuratorate of Jincheng City, Shanxi Province takes the rectification of the hidden dangers of mine personnel positioning system equipment as the breakthrough point, and promotes the administrative organs to carry out a special inspection of 115 normal production and construction coal mines in the city for a period of four months, and builds a working mechanism of whole process control, all-round inspection and full coverage supervision, and establishes a blacklist system for mining electrical equipment of coal mining enterprises, effectively preventing hidden dangers in production safety in the coal industry. For key industries such as water conservancy projects and natural gas, procuratorial organs play a preventive role in public interest litigation and promote the source management of safe production.
